The agreement between you and Eternal Sunshine Global governing our AI-powered applications, website, and development services.
Last Updated: September 7, 2025Please read these Terms of Use ("Terms") carefully. They form a legally binding agreement between you and Eternal Sunshine Global ("we", "us", "our") covering your access to and use of our websites, our mobile and web applications (the "Apps"), and our AI development services (the "Services").
By downloading, installing, accessing, or using our Apps, website, or Services, you acknowledge that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy, which is incorporated here by reference. If you do not agree with any part of these Terms, you must not use our Apps or Services.
You must be at least 13 years of age to use our Apps. If you are between 13 and the age of majority in your jurisdiction, you may use our Apps only with the involvement and consent of a parent or legal guardian, who agrees to be bound by these Terms on your behalf. If you are using the Apps or Services on behalf of a company or other organisation, you represent that you have authority to bind that entity to these Terms.
You are responsible for ensuring that your use of our Apps and Services is lawful in your country of residence.
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to download and use our Apps for your personal, non-commercial purposes on a device that you own or control. Business use of our Apps is permitted only where a plan or written agreement expressly allows it.
You may not, and may not permit anyone else to:
Our Apps and Services include artificial intelligence features. When using them, you agree not to submit inputs or generate outputs that:
AI outputs are not guaranteed to be accurate. Generative and predictive systems can produce results that are incorrect, incomplete, biased, or misleading. You are responsible for reviewing and verifying any output before relying on it, and for any decision you make on the basis of that output. Do not use our AI features as the sole basis for decisions with legal, medical, financial, or safety consequences.
You retain ownership of the content you submit to our Apps and Services ("Input"). You grant us a limited, worldwide, royalty-free license to host, process, and transmit your Input solely for the purpose of operating the Apps and delivering the results you request.
As between you and us, and to the extent permitted by applicable law, you own the outputs generated for you from your Input ("Output"). You are responsible for ensuring you hold the necessary rights to your Input and that your use of the Output complies with applicable law. Because AI systems may generate similar outputs for different users, we make no claim that any Output is unique to you.
Some features require a paid subscription. Available plans, pricing, and billing periods are shown in the App before you purchase. Prices may vary by country and currency and may include applicable taxes.
Subscriptions purchased inside our mobile Apps are processed exclusively by the Apple App Store or Google Play Store. Payment is charged to your app store account at confirmation of purchase. We do not receive or store your payment card information.
Subscriptions automatically renew for the same period unless you cancel at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours prior to the end of the current period. You can manage and cancel subscriptions in your app store account settings; deleting the App does not cancel a subscription.
We reserve the right to change subscription prices. Any change applies only to future billing periods, and we will provide advance notice as required by the applicable app store and by law. Where required, we will seek your consent before a higher price takes effect.
Refunds are governed by the policies of the app store through which you purchased. iOS users should request refunds through Apple; Android users should request refunds through Google Play. We are generally unable to issue refunds directly for app store purchases.
If you are a consumer in the European Union or the United Kingdom, you have a statutory right to withdraw from a purchase within 14 days. By starting to use digital content immediately, you may be asked to acknowledge that this right lapses once delivery has begun. Nothing in these Terms limits mandatory consumer rights available to you under local law.
The Apps, the website, and all content, features, functionality, models, designs, text, graphics, and software are owned by Eternal Sunshine Global or its licensors and are protected by international copyright, trademark, and other intellectual property laws. Except for the limited license in Section 3, no rights are granted to you.
"Eternal Sunshine Global" and our logos are our trademarks. You may not use them without our prior written permission.
Where we deliver custom AI development work for a business client, that engagement is governed by a separate written agreement — a statement of work, master services agreement, or equivalent. In the event of a conflict between these Terms and such an agreement, the signed agreement controls with respect to that engagement. Deliverables, ownership of custom work product, confidentiality, and service levels are defined in that agreement, not here.
Our Apps and Services rely on third-party providers, including cloud infrastructure, analytics, subscription management, and AI model providers. Your use of those components is also subject to the relevant third party's terms. We are not responsible for the availability, performance, or practices of any third-party service, and their inclusion does not imply endorsement.
The apps, website, and services are provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
We do not warrant that the apps or services will be uninterrupted, secure, or error-free; that defects will be corrected; that results or ai outputs will be accurate, complete, or reliable; or that the apps will meet your requirements.
Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you. In that case, our warranties are limited to the minimum extent permitted by law.
To the maximum extent permitted by applicable law, Eternal Sunshine Global shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or business opportunity, arising out of or relating to your use of the apps or services, whether based in contract, tort, or any other legal theory, even if advised of the possibility of such damages.
In no event shall our total aggregate liability exceed the greater of (a) the amount you paid us in the twelve months preceding the event giving rise to the claim, or (b) one hundred United States dollars (US $100).
Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded under applicable law. If you are a consumer, these limitations apply only to the extent permitted in your jurisdiction.
You agree to indemnify, defend, and hold harmless Eternal Sunshine Global, its officers, employees, and contractors from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising from your use of the Apps or Services, your violation of these Terms, your violation of any law or third-party right, or any content you submit.
You may stop using our Apps and Services at any time by deleting the Apps from your devices. Deleting an App does not cancel an active subscription — cancel that separately in your app store account settings.
We may suspend or terminate your access to the Apps or Services, in whole or in part, if you breach these Terms, if we reasonably suspect fraud or abuse, or if we are required to do so by law. Where circumstances allow, we will give you reasonable notice and an opportunity to remedy the issue.
On termination, the license granted in Section 3 ends immediately. Sections 5, 7, 10, 11, 12, 14, and 15 survive termination.
We may update the Apps at any time, and updates may add, modify, or remove features. We may also modify these Terms. When we do, we will revise the "Last Updated" date and, where the change is material, notify you in the App, on this website, or by email before it takes effect. Continued use of the Apps or Services after the effective date constitutes acceptance of the revised Terms. If you do not accept them, you must stop using the Apps and Services.
These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict of law principles, except where the mandatory law of your country of residence provides otherwise. Consumers in the European Union, the United Kingdom, and other jurisdictions with mandatory consumer protection rules retain the protection of the mandatory provisions of their local law.
Before starting any formal proceeding, please contact us at support@eternalsunshineglobal.com so we can try to resolve the matter directly. Most concerns can be settled this way, and we commit to responding in good faith within 30 days.
If a dispute cannot be resolved informally, it will be settled by binding individual arbitration, and you and we each waive the right to a jury trial and to participate in a class or representative action. This subsection does not apply where prohibited by law, and does not apply to consumers resident in the European Union or the United Kingdom, who may bring proceedings in the courts of their place of residence.
Consumers in the European Union may also use the European Commission's Online Dispute Resolution platform. We are not obliged to participate in dispute resolution proceedings before a consumer arbitration board.
You represent that you are not located in, and are not a national or resident of, any country subject to a comprehensive embargo, and that you are not on any restricted party or sanctions list. You agree not to use, export, or re-export our Apps or Services in violation of applicable export control or sanctions laws.
We operate globally, but our Apps and Services are not available in every country, and some features may be restricted in certain jurisdictions for legal or technical reasons. If you access our Apps from a location where they are not offered, you do so on your own initiative and are responsible for compliance with local law.
These Terms are between you and Eternal Sunshine Global only, not with Apple Inc. Apple is not responsible for the Apps or their content, and has no obligation to provide maintenance or support. If an App fails to conform to any applicable warranty, you may notify Apple, which may refund the purchase price; Apple has no other warranty obligation. Apple is not responsible for addressing any claim relating to the Apps, including product liability, legal or regulatory non-compliance, or intellectual property claims. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
These Terms are between you and Eternal Sunshine Global only, not with Google LLC. Google is not responsible for the Apps or their content and has no obligation to provide support or maintenance. Your use of Google Play is governed by the Google Play Terms of Service.
Severability. If any provision of these Terms is held invalid or unenforceable, it will be limited or removed to the minimum extent necessary, and the remaining provisions remain in full force.
Entire Agreement. These Terms and the Privacy Policy constitute the entire agreement between you and us regarding the Apps and Services, superseding any prior understanding, except where a signed services agreement applies under Section 8.
No Waiver. Our failure to enforce any right or provision is not a waiver of that right or provision.
Assignment. You may not assign or transfer your rights under these Terms without our written consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets.
Force Majeure. We are not liable for any failure or delay caused by events beyond our reasonable control.
Language. These Terms are drafted in English. Any translation is provided for convenience; in the event of conflict, the English version prevails except where local law requires otherwise.
